WILL DONALD TRUMP’S TWO IMPEACHMENTS BE EXPUNGED?

Question 1): According to The Wall Street Journal, President Donald Trump and his allies are fixing to push GOP lawmakers in the U.S. House of Representatives to pass a resolution that would formally “expunge” his two impeachments,  which were based on his efforts to solicit help from Ukraine in the 2020 election and for his role in influencing the Jan. 6, 2021, attack on the U.S. Capitol building.

Both impeachments did not receive the constitutionally required 2/3 vote in the Senate required to convict and remove Trump from office. The Senate conviction tally for the 2021 impeachment did achieve a majority vote, but that wasn’t enough.

The resolutions would largely be symbolic because the Constitution doesn’t actually specify that impeachments can ever be formally rescinded and would not have any practical effect, since Trump wasn’t convicted and removed from office in either case.

Nevertheless, House Speaker Mike Johnson has suggested he might put on the House agenda expungement of the two impeachments votes taken during Trump’s first of term, when Democrats controlled the House (2019-2023) under Speaker Nancy Pelosi. It would probably be after the November 3 election.

Retired attorney Bob LaBrant, who knows constitutional law, observes that expungement of an impeachment has no precedent or legal effect; it would be largely symbolic. A resolution of expungement would be reported out of the Judiciary Committee, chaired by U.S. Rep. Jim Jordan of Ohio. A House resolution requires just a simple majority vote (50%+1) to be adopted. Since it is not a bill, a House resolution does not need passage by the Senate or to be signed by the President.

So, the question is why would Speaker Johnson bring an expungement vote to the House floor?

Answer 1): Politically, it defies reason why he would. Johnson would be throwing his entire caucus under the bus just to kowtow to Trump. It would haunt Johnson’s party in 2028 and long after Trump has left office.

Republicans currently hold a slim majority (218-R, 212-D, 1-Independent, and 4 vacancies). The Speaker could attempt to ram a expungement vote through the House on a near party line vote. Every Democrat in the House will oppose expungement.

If Republicans lose control of the House, as expected in this year’s elections, Democrats would guarantee that expungement would be dead for the rest of Trump’s presidency.
Speaker Johnson likely has already explained to Trump a near party line vote to achieve a majority is unlikely if not impossible. Dan Newhouse (R-WA) and David Valadao (R-CA) are two remaining Republican lawmakers who voted for Trump’s impeachment in 2021. Then there are Tom Massie of Kentucky and Nancy Mace of South Carolina, who Trump worked to successfully defeat in Republican primaries for the House and for Governor. U.S. Rep. Chip Roy did not receive a Trump endorsement for Texas Attorney General. Don Bacon (R-Nebraska), who is retiring, has been a consistent maverick. He  signed five discharge petitions this term, end-running the Speaker.
So, given its improbability, why would Speaker Johnson bring an expungement vote to the floor?
The Speaker knows that Trump is mercurial and vindictive. Senator John Cornyn from Texas voted with Trump 99.3% of the time, yet Trump endorsed Ken Paxton, the Lone Star State’s attorney general, in this month’s Senate GOP primary, abetting Cornyn’s defeat.
Trump feels he needs expungement to remove the stain of impeachment on his legacy and because he believes he “did nothing wrong.” We have no evidence Speaker Johnson has stood up to Trump, either privately and certainly not publicly, and told him “We’re not doing this.”

Trump can use the Cornyn example to weigh in and use an expungement vote as a personal test of every Republican member’s loyalty to him and use that roll call vote in 2028 in GOP primaries before he leaves the presidency, perhaps as a final act of retribution.

Holding a vote on expungement will not help Congressmen Tom Barrett (R-Lansing) and Bill Huizenga R-Zeeland) in the two Michigan districts that look currently to be the most vulnerable for the GOP. If an expungement roll call is held before 11/3, a Yes vote would be fatal to Barrett and it would hurt Huizenga as well. If both win re-election this year, either a Yes or a No vote by either of them on a lame duck expungement resolution might have serious consequences for them in 2028, in both the primary and general elections depending on what they decide to do should Trump and Johnson force them to “kiss the ring.”

    And Shamdyl Bill Ballenger becoming just another Trump Enabler like the rest of his Lackeys by even brining up EXPUNGEMENT ! He should be Impeached and then Removed by the Senate !!!

    If anything, this proposal will be taken up AFTER the November elections, especially if the GOP loses the house. But the vote may still not be there for reasons stated above. Or we may never hear of it again. Keep in mind one thing about DJT; he is the Master of the Bluff. How many other times has he proposed something only to let it flounder after it has achieved its initial purpose? (In this case bringing to the surface those who are his true allies, the lukewarm, and outright enemies.)

    A royal waste of time and effort but so was the redecoration of the reflecting pool and the renaming of the Kennedy Center. As Absolutely The Truth suggests, it would be an affront to all of us.
